<p>Instead of requesting permission in advance, the court instructed her to notify it and the Enforcement Directorate at least three days before she planned to leave the country.</p>

<p>The actress has to fly overseas quickly in order to take advantage of business chances, according to Special Judge Shailendra Malik, who released Fernandez on bail on November 15 of last year. The judge also noted that Fernandez has never abused the bail restrictions in the past.</p>

<p>In an order issued on August 10, the judge relaxed the requirement, stating that obtaining the court’s prior approval before leaving the country “becomes cumbersome and may be a reason for losing livelihood.”</p>

<p>The judge had warned Fernandez “not to leave the country without prior permission of the court” when giving her bail.</p>
<p> </p>
<p>The court took notice of the fact that Fernandez was called as a witness in a similar case being looked into by the Delhi Police’s Economic Offence Wing (EOW) even though she was currently on trial in the money laundering case being investigated by the ED.</p>

<p>The court said that it was also unquestionable that the accused never took advantage of the bail terms.</p>
<p> </p>
<p>The court said that the only reason the accused was required to get prior authorization before leaving India was to guarantee that she would present throughout the course of the trial and that there would be little chance of her evading the legal system.</p>
<p> </p>
<p>“In the current instance, I believe that taking into account the fact that the accused is an actress in the Indian film business and regularly travels overseas, as well as the fact that in certain circumstances, she has to leave the country quickly in order to take advantage of professional possibilities, is relevant.</p>
<p> </p>
<p>The need to get prior authorization before leaving the nation becomes burdensome in such circumstances and may result in livelihood loss, the court added.</p>
<p> </p>
<p>The court further observed that Fernandez was a Sri Lankan national who had moved to India in 2009 and had been doing so ever since.</p>
<p> </p>
<p>The court noted that there has never been a situation in which the accused has broken a bail requirement.</p>
<p> </p>
<p>“I believe that it would be reasonable and equitable to adjust bail requirements for obtaining prior authorization before leaving the nation in such a circumstance when the apprehension of the investigating agency may be alleviated by adding some additional restrictions. As a result, the accused’s application is being accepted, the judge stated.</p>
<p> </p>
<p>Fernandez said in her application that, “being an internationally recognized performer, she constantly participated in filming, appearances at events, participation in numerous award celebrations, etc. being essential to her life and professional pursuits. The accused may find it time-consuming to get the court’s authorization before traveling overseas, which is required under the bail conditions.</p>

<p>The application stated that as a result, the accused has encountered circumstances where organizers, producers, and other members of the film industry have chosen to work with other people rather than go through the time-consuming process of getting court permission to leave India, potentially causing her financial loss and reputational damage.</p>

<p>In the case, the court had granted Fernandez release in exchange for a 50,000 rupee personal bond and one surety in the same amount.</p>
<p> </p>
<p>On August 31, 2022, the court ordered Fernandez to appear in court after taking cognizance of a supplemental charge sheet submitted by the Enforcement Directorate (ED).</p>
<p> </p>
<p>In the supplemental charge sheet, Fernandez, who had previously been subpoenaed by the ED in connection with the investigation, was for the first time listed as an accused.</p>
<p> </p>
<p>She was not included as an accused in either the original charge sheet or the supplemental charge sheet from the ED.</p>
<p> </p>
<p>The specifics of the remarks made by Fernandez and colleague performer Nora Fatehi were, however, disclosed in the records.</p>
